Effective Date: August 25, 2026. Growfitable ("we", "our", or "us"), a digital product and communication platform operated by Codecurv, provides its website, Growth OS, and communication SaaS modules subject to these binding governance terms.
1. Legal Entity Ownership & Intellectual Property
This website, the Growfitable Growth OS, and associated proprietary SaaS modules (including WaLink Pro) are owned, engineered, and legally operated by Codecurv. All custom source code, CSS design tokens, framework-free architectures, 60FPS UI components, vector assets, and software logic on this platform are the exclusive intellectual property of Codecurv.
- ✓Proprietary Systems & Software: You may not copy, reverse-engineer, decompile, scrape, redistribute, or duplicate our software structures, visual designs, or branding assets without explicit prior written authorization from Codecurv.
- ✓Client Deliverables & Work Product: Custom technical deliverables developed specifically for contracted clients are formally transferred upon complete settlement of contractual fees under specific Master Service Agreements (MSAs) and Scope of Work (SOW) documents executed with Codecurv.
2. Interactive Tools, SaaS Modules & Service Delivery
Growfitable provides diagnostic audit utilities, interactive ROI calculators, and multi-tenant lead management SaaS tools (including WaLink Pro) for operational and analytical purposes:
- ✓Algorithmic Simulations: Calculated estimates, projected revenue lifts, and automated health scores are algorithmic projections based on mathematical models and do not constitute guaranteed commercial outcomes or unilateral binding quotes.
- ✓Service Level Agreements: Commercial terms, technical SLAs, and deliverable schedules are governed exclusively by formal Statements of Work executed directly between your organization and Codecurv.
3. Acceptable Use & WhatsApp Business Messaging Compliance
All users, authorized clients, and connected business accounts must strictly comply with platform integrity rules and official Meta Platform Policies:
- ✓Meta Terms Compliance: Clients connecting WhatsApp Business Accounts agree to adhere fully to Meta’s WhatsApp Business Terms of Service and WhatsApp Commerce Policy. Sending spam, unsolicited marketing blasts, or messages without verifiable prior opt-in consent is strictly prohibited.
- ✓Infrastructure Protection: Deploying automated crawlers, scrapers, bot networks, denial-of-service (DoS) payloads, or vulnerability probing tools against Codecurv or Growfitable infrastructure results in immediate account termination and legal escalation.
4. Limitation of Liability & Third-Party Platform Disclaimers
This platform and its diagnostic tools are provided on an "as is" and "as available" basis. Codecurv and Growfitable disclaim all warranties, express or implied, regarding search engine algorithm shifts, third-party API policy modifications (e.g., Meta Cloud API, Google Services), or upstream hosting network disruptions beyond direct platform control.
In no event shall Codecurv, Growfitable, or its officers be liable for indirect, incidental, consequential, or punitive damages arising from the use of public materials, blog insights, or automated software modules.
5. Governing Law & Legal Contact
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal proceedings or disputes arising under these terms shall be subject to the exclusive jurisdiction of the competent courts in Rajasthan, India.
